      Ha pasado una semana y el 99,9% de la EDM scene e industria musical está en el lado de Adam. No será por interés, desde luego. Muchos de ellos precisamente no se cortan un pelo... Digamos que saben hacer números 1.

Yet I don’t think you’re in a position to be calling plagiarism when your track is a direct copy of something else See it for what it is mate.
      • Josh Goodwill: Love your original, but cutting up a 2 second loop of your record, pitching it, changing the timing of the grid to match his (then fading out when it would clash) is not him sampling / stealing IP! If that’s the case I could match thousands of other people’s records and the courts would have a lifetime of clients being sued!

      • Shaun Frank: I mean….this is a bit of a stretch. You’re going back and forth between two notes, and not in the same pattern if you count from the 1. The chords of his song are completely different. The key is different (you’ve pitched it in the video). So the melody is only a match if you loop from a different point in the melody, and it’s 2 notes, so…I dunno on this one .
      • BtheLickMusic: No nick , that is not the original offshore that we remember, what you show has been pitched down 5 semitones to a different key, heavily tone manipulated in attempt to match, AND you had to manipulate the rhythm too.
      • Standerwick: I respect u dude, and you have been an inspiration, but have to disagree. There’s no melody robbed here imo, just an accompaniment of notes. No one owns the 12 notes we spent our lives tinkling away on.
      • Lezenmusic: Interesting to note that Calvin’s already shown on socials + stated in interviews the melody has come from him recording multiple layers / takes of a new guitar he bought to form chords. To me, that shows he was intentional with his play style when writing the song to go for a euphoric, baleric style melody. Offshore absolutely uses this same technique, but so do many other records from the same era. That’s the thing about writing a hit - repeat the techniques that make it special and it becomes a trope. Copy that trope when it still feels “current” and it ends up feeling cheesy or unimaginative. Give that trope enough time to breathe and it actually ends up feeling nostalgic over time to certain people. What you created with tracks like Offshore and Saltwater was a sound that everyone wanted, and though at the time many tried to replicate it, none of those imitator’s songs have stood the test of time. Contrastingly, I think it’s now to a point where those songs feel nostalgic, so copying things like rhythmic pattern or chord progressions ends up being a subconscious tribute to your work rather than a straight sample or copy. At most, there is definitely argument for it being interpellation, but suggesting that it’s a direct copy would also set a precedent for someone like Anyma to sue every single Melodic Techno producer out there right now who uses an arpegiated lead with the rate set to free, or someone like Odd Mob to sue every single Tech / Bass House producer who puts a big bass donk on the one beat of their drop.

The whole reason for wishing to take action is the feeling that a certain intention was there, a trope or homage has respect behind it, with the intention to purposefully not copy but instead credibly replicate the nuances of the genre / sounds used in that little time bubble with a fully original piece! Then there’s “sound-a-likes” ones where it’s clearly based on someone’s work, to the point that people say “when I heard it I thought it was your song”. So even after all the “it’s not the same melody” and “you can’t copyright a guitar” and “it’s just - 1-7 minor” and even a musicologist says “musically speaking there are enough differences for this not to be an infringement”. There’s still the argument that your song could have been a key influence in the creation of the new work and without your work, the new work wouldn’t exist. That was the argument in the uptown funk / oops upside your head case I believe which they won, but also the argument in the Gaye estate vs Sheeran case which they lost, so it’s 50/50. I’ve worked with Calvin back in the day he’s talented and respectful (despite the response video!) - if you guys got together hugged it out and created something new together - you’d create the next Mona Lisa - I promise you! I really hope that is the outcome of this, cos lawsuits take a piece of your soul, and life that you can never get back. C’mon @calvinharris let’s do this?!….

      Calvin Harris “Blessings”: plagiarism? ‍♀️ Does Calvin Harris’ new song “Blessings” evoke elements of Chicane’s 1997 “Offshore”? Some of the sounds, rhythms and melodies may be similar, but those aspects are not protectable by copyright. And perhaps more importantly: they aren’t even identical to begin with!

      Pues claro, es que es lo mismo y es distinto. Si en la época de "Offshore" hubiera aparecido un tema así al cabo de poco, seguramente todos habríamos asumido que se trata de la clásica producción a rebufo, evidentemente sin creditar al original, y mala suerte, chico, has creado un estilo, pues te salen imitadores. Robert Miles inauguró una senda que muchos siguieron, lo mismo Benny Benassi. En este caso el parecido sí es más llamativo y es a todas luces un "homenaje". Pero no puedes quejarte de no cobrar royalties ni tampoco es justo achacarle a Harris falta de imaginación cuando él mismo ha tirado del carro del dance comercial mucho tiempo haciendo de avanzadilla. Chicane me parece una leyenda y una institución del dance y es cierto que había sido poco o nada imitado, incluso en la oleada de refritos noventeros que estamos viviendo en estos tres últimos años. Quizá por eso vemos que este estilo plasmado en este tema, tan reconocible pero tan poco gastado, nos evoca directamente al sonido Chicane. Pero ojo, el estilo house y trance balearic viene siendo bastante esto mismo y nadie se llevó las manos a la cabeza.

      Sea como sea, esto al final se llama: promoción, promoción, promoción.
      Pues, totalmente de acuerdo con @rusticman . Hay muchos temas que sido copiados, homenajeados, o que han servido de inspiración para nuevas canciones. Otro ejemplo de los 90 fue el sonido pizzicato, del que salieron producciones como setas. O la "makineta" catalana (especialmente la de pitos) donde la estructura, sonidos y desarrollo del tema era un calco constante. Otro ejemplo claro fue el "Fly on the wings of love" que salió a rebufo del ”Flying Free" replicando la misma fórmula y sonoridad. Pero nada de eso era un plagio, de hecho a "Flying Free" es al que se le podría acusar de plagio porque copiaba la melodía de otro tema, pero eso ya es otra historia.

      Para centrarnos en la cuestión Calvin - Chicane, no hay un plagio de una melodía como tal porque son 3 notas (o tres acordes) que se van repitiendo, y eso no puede tener autoría como tal. Pero sí, lo recuerda, muchísimo, aunque no me parece ni mucho menos como para poner demandas. Claro que sí hay opción de pillar algo de pasta Chicane tirará para adelante. Tampoco me gusta nada la respuesta de Calvin en ese vídeo con tanto "fucking, fucking, fucking, it's not the fucking same" no me parecen formas la verdad.

      Y ahora la bomba que tengo para lanzaros, "Offshore" es del 96, pues fijaos en el tema que sacó "Plastic"un año más tarde. ¿Os suena? Pues que yo sepa a estos Chicane no los demandó.
